Terms of service

Terms of service

Last updated: 15 October 2026

These Terms of Service ("Terms") set out the rules for using the online store at leonarto.studio ("Store") and for buying products through it. They apply to every Customer and User of the Store.

These Terms form one set with our other policies: the Privacy Policy, the Returns & Refunds Policy and the Shipping Policy, all published on the Store. Those documents are separate pages, they form part of these Terms, and the practical details of delivery, damage, loss and returns are set out there. Read them together with these Terms before ordering.

1. Definitions

  • Seller, "we", "us", "our" — Bargen Invest Krystian Będkowski (hereinafter “Bargen Invest”), with its registered office at Henryka Barona 18/17, 82-300 Elbląg, Poland, VAT ID PL5783137952, email contact@leonarto.studio.
  • Store — the online store at leonarto.studio, operated by the Seller.
  • Customer — an adult natural person with full legal capacity, a legal entity, or an organisational unit without legal personality but granted legal capacity by law, using the Store with the intention of buying Products.
  • Consumer — a Customer who is a consumer within the meaning of Polish consumer law and Directive 2011/83/EU.
  • Consumer-Entrepreneur — a natural person running a sole proprietorship who enters into a contract directly connected with that business, where the contract is not of a professional nature for them, as defined in Polish consumer law.
  • User — a Customer who has registered an Account in the Store.

  • Product — an item offered by the Seller through the Store and forming the subject of a Contract.
  • Offer — the Seller's presentation of a Product in the Store, including its price and availability.
  • Order — the Customer's declaration of intent to enter into a Contract on the terms stated in the Order.
  • Contract — a distance sale contract for a Product, concluded between the Seller and the Customer through the Store.
  • Service — the electronic services the Seller provides through the Store, in particular access to the Store's content, tools and functions, enabling Customers to view Offers and place Orders.

  • Content — everything published in the Store, including Offers, descriptions, photographs, artwork images, and reviews and other material submitted by Customers.
  • Illegal Content — information that is not in compliance with Union law or the law of a Member State which is in compliance with Union law, within the meaning of Article 3(h) of Regulation (EU) 2022/2065 (Digital Services Act).

2. General provisions

The Store is operated by the Seller. It runs on the Shopify platform: Shopify provides the technology, hosting and checkout, but it is not the seller. Your Contract is concluded only with the Seller.

These Terms define the conditions on which the Seller provides the Service, including the rules and procedure for concluding Contracts with Customers.

The Seller provides the Service free of charge. The agreement for the provision of the Service is concluded when the Customer begins using the Store, or — for functions requiring registration — when the Account is activated, and is concluded for an indefinite period. Its termination is governed by section 9.

Using the Store, including providing personal data, is voluntary. However, without certain data or without consent to certain functions, we cannot provide the Service or perform a Contract — for example, we cannot deliver a Product without a delivery address.

The Seller is the controller of personal data processed in connection with these Terms. The purposes, legal bases, retention periods, recipients and data-subject rights are described in the Privacy Policy.

Nothing in these Terms limits the rights of a Consumer or Consumer-Entrepreneur under mandatory provisions of law. If any provision of these Terms conflicts with such provisions, the law prevails and we will apply the law. This applies in particular to the rights described in sections 10 and 12.

3. Technical requirements and acceptable use

To use the Store you need: a computer or other device with an operating system that supports current internet browsers; a working internet connection; cookies and JavaScript enabled; and, where the Service is used by email, an active and correctly configured email account.

The Seller uses cookies and similar technologies in accordance with the Privacy Policy.

You may not use the Store in a way that enables or is intended to enable: unauthorised access to the Seller's or anyone else's IT systems; introducing malware, illegal content or any harmful code; disrupting the functioning of the Store; scraping, crawling or systematic extraction of the Store's Content; placing Orders by automated means, including to buy up limited items; or reselling or otherwise exploiting the Service itself. A breach may lead to blocking of access under section 9.

4. Account registration

Registration is optional. It is done through the form in the Store by providing an email address and setting a password. You will receive an activation link at that address.

Registration requires reading and accepting these Terms. One User may hold only one Account. You must give true and accurate data and keep it up to date, and you must keep your login and password confidential and protect them from third-party access. Only Users have access to the full range of the Store's functions, in particular the order history in their Account.

5. Placing orders and concluding the Contract

You place an Order by adding Products to the cart and proceeding to checkout, where you provide your details, the delivery address, the delivery method and the payment method, and may add comments to the Order. To place the Order you must accept these Terms.

The Contract is concluded when you click the button labelled to make clear that it creates an obligation to pay ("Order with payment obligation"). That click means you confirm the Order on the terms shown. Immediately afterwards you receive an Order summary on a durable medium — by email and on the confirmation screen — containing the details of the Contract and the information needed to pay.

The Seller may refuse or cancel an Order where: the Product is unavailable; the Order appears to be placed for resale or in unusual quantities; we suspect fraud, misuse or unlawful activity; or the Store contained an obvious error as to price, discount or stock.

An obvious error means a price or availability that is plainly wrong and did not result from our normal pricing — for example a wrongly applied discount or an automation failure. Every such case is documented, and you are informed without delay. The notice will offer you the choice of modifying the Order, accepting the corrected price (with information about any additional payment), or cancelling the Order with a full refund. If we cancel, we refund everything you paid.

The Seller may not change the essential terms of an Order without your consent. Once an Order has entered production or been dispatched, it can no longer be modified.

6. Prices, taxes and payment methods

Prices are shown in the currency of your country or region. For deliveries within the European Union, prices include VAT at the rate of the country of delivery, which we settle through the EU One-Stop Shop (OSS). For deliveries outside the European Union we do not charge VAT or any local sales tax. In every case the price displayed at checkout is the total price.

Proof of purchase. We issue a personalised invoice (faktura imienna) made out in the Customer's name and send it electronically to the email address given in the Order. By placing an Order you agree to receive the invoice in electronic form, and we do not charge you for it. You are responsible for giving us complete and correct invoice details in the Order, including your name and address and, where applicable, your VAT identification number. If an invoice needs to be corrected, contact us at contact@leonarto.studio.

The total amount payable is the amount shown at checkout immediately before you confirm the Order. We do not charge surcharges for card or other online payment methods beyond the cost we are charged for them. Optional extras are added only if you expressly select them; we never add paid extras by default and never treat your silence as consent to a payment.

Where we announce a price reduction, we also indicate the lowest price at which the Product was offered during the 30 days before the reduction.

Products are printed locally, at the facility closest to your delivery address (section 7), and we do not charge import duties or customs fees. If a carrier or customs authority asks you to pay such amounts for one of our parcels, contact us before paying.

Payment methods. Payments are processed through Shopify Payments and PayPal. Depending on your location and the currency of your Order, the methods available at checkout may include:

  • payment cards — Visa, Mastercard, American Express, Maestro and UnionPay;
  • accelerated checkouts — Shop Pay, Apple Pay and Google Pay;
  • PayPal;
  • local methods shown according to your location — BLIK (Poland), iDEAL | Wero (the Netherlands), Bancontact (Belgium), MB WAY (Portugal) and MobilePay (Denmark and Finland);
  • USDC (a digital currency pegged to the US dollar), where available at checkout.

The methods actually offered for your Order are those displayed at checkout when you place it. Payment methods cannot be combined within one Order. We do not store your full card details.

You confirm that you are authorised to use the payment method you choose. If a payment fails, is reversed or is not authorised, we may cancel the Order. If you believe a charge is wrong, contact us first at contact@leonarto.studio — we will investigate before you need to involve your bank.

7. Production and delivery

Our Products are printed to order in our partner network of printing facilities, at the facility closest to your delivery address, and shipped from there directly to you — not from the Seller's address in Poland. Shipping of unframed posters is free to every country we ship to; for framed posters and framed canvases we charge one shipping fee per order, as set out in the Shipping Policy. Dispatch takes 1–4 Business Days for unframed posters and 2–5 Business Days for framed items, and delivery 2–7 Business Days after dispatch. The details, including the list of countries and the countries where framed items are available, are in the Shipping Policy and are shown at checkout.

Unless we agree otherwise with you:

  • European Union: we deliver within 30 days of the Contract. If we fail to deliver, you may set an additional reasonable period and, if we still do not deliver, cancel the Contract and receive a full refund.
  • United States: we comply with the FTC Mail, Internet, or Telephone Order Merchandise Rule. If we cannot dispatch within the time stated or, if no time is stated, within 30 days, we will notify you, give a revised shipping date and offer you the choice of accepting the delay or cancelling for a prompt refund.
  • Canada: if we do not deliver within 30 days of the date stated in the Order, or within 30 days of the Contract where no date is stated, you may cancel the Contract and receive a refund, as provided by the consumer protection law of your province or territory.

Risk of loss or damage. The risk of loss of or damage to the Products passes to you only when you, or a person you nominated other than the carrier, physically receive the goods. Until that moment the risk is ours. You are not required to inspect the parcel in the presence of the courier, and we do not make any claim subject to such an inspection.

Goods are delivered to the address you give us; please check it before confirming the Order. What happens if a parcel cannot be delivered, is refused, is not collected, arrives damaged or goes missing in transit, and how to report it, is set out in the Shipping Policy and the Returns & Refunds Policy.

An Order may be delivered in several parcels; each parcel is a separate delivery for the purposes of these Terms.

8. Reviews, user content and illegal content

Product ratings and reviews are collected and hosted through our review platform, Judge.me (Judge.me Ltd), and displayed in the Store. Reviews are submitted by customers who bought from us or who reviewed us through the platform.

An individual review belongs to the person who wrote it. We can publish, hide or archive a review, but we cannot edit its text, its images or its star rating, and we cannot change the rating an author gave.

When you submit a review or other content, you confirm that it is your own, is based on your genuine experience, is accurate and does not infringe anyone's rights, and you grant us a non-exclusive, free licence to display and use it in connection with the Store for as long as it remains published.

Rules for content. You may not publish content that is: untrue or misleading about its origin; unrelated to the Product or to the transaction; offensive, vulgar, hateful, racist or xenophobic; unlawful; revealing of another person's private information; commercial spam or an unsolicited promotion; or containing malware. You may not publish a review in exchange for payment or a benefit without disclosing it, and you may not review us if you are a family member, an owner or an employee of a competing business.

Moderation. Reviews are published automatically by default, and we moderate them. If we hide or archive a review, we record one of the following reasons, and we apply them consistently: the review is fake; it is a duplicate; it is spam; it is unrelated to the Product; there are legal reasons; it contains inappropriate language; it contains private information; or another reason of the same kind. We do not hide reviews simply because they are unfavourable. We do not write, commission or buy reviews, we do not present sponsored content as a customer review, and we do not suppress negative feedback.

Reporting content. If you believe a review or other content in the Store is unlawful, email contact@leonarto.studio with the address (URL) of the content, why you believe it is unlawful, and your name and email address. We confirm receipt, review the report promptly and objectively, and tell you what we decided — removal, modification or keeping the content — and why.

9. Term of the Service, termination and blocking access

The agreement for the provision of electronic services not requiring registration is concluded when you begin using the Store and ends when you stop. The agreement for services requiring registration is concluded for an indefinite period when your Account is activated.

You may terminate the agreement at any time by deleting your Account — the deletion link is available in your Account settings and is confirmed by email. Using that link deletes the Account and terminates the agreement.

The Seller may terminate the agreement with a User who breaches these Terms, giving at least 14 days' notice, in particular where the User: provides false personal data; uses the Account or other functions contrary to their purpose; publishes reviews or comments that breach section 8; breaches the law, accepted social norms or good practice, in the Store or towards the Seller; or acts contrary to section 3.

The Seller may also temporarily block access to the Store in the situations listed above. Blocking may be applied together with termination. Where the breach is serious, the Seller may act immediately, to the extent the law permits.

A Consumer or Consumer-Entrepreneur may withdraw from the agreement for the provision of electronic services within 14 days of its conclusion, on the terms set out in section 10. That right does not apply where the Seller has, with your prior express consent, begun providing the Service before the withdrawal period expired.

10. Right of withdrawal — consumers in the EU, EEA and UK

If you are a Consumer or a Consumer-Entrepreneur in the European Union, the EEA or the United Kingdom, you have the right to withdraw from the Contract within 14 days of receiving the Product — or, where the Contract covers multiple Products delivered separately, within 14 days of receiving the last Product, batch or part.

How to withdraw. You must inform us of your decision by an unequivocal statement. An email to contact@leonarto.studio is enough, or you may send the model form below by email or post to the Seller's address. You do not need to give a reason and you do not need our consent. We do not require you to present a receipt or any proof of purchase: your Order and its confirmation are our records. To meet the deadline it is enough to send the statement before it expires.

Returning the Product, the return address and the practical steps are set out in the Returns & Refunds Policy. You must send the Product back without undue delay and no later than 14 days from the date you informed us. You pay the direct cost of returning the Product; we do not provide return labels.

Refund. We refund the price you paid together with the cost of the cheapest standard delivery we offer, within 14 days of receiving the Product back or of receiving proof that you have sent it, whichever comes first. We may withhold the refund until we receive the Product back or proof of dispatch. We refund using the same payment method you used, unless you expressly agree otherwise, and we charge no fee for the refund. If you chose a more expensive delivery method than our standard one, we reimburse only the standard delivery cost.

Your handling of the Product. You may inspect and test the Product to the extent necessary to establish its nature, characteristics and functioning — as you could in a shop. You are responsible for any reduction in value resulting from handling beyond what is necessary. That is a claim for compensation for diminished value; it is not a ground on which we may refuse your withdrawal.

When the right of withdrawal does not apply. It does not apply to: goods made to your specification or clearly personalised; goods delivered in sealed packaging that cannot be returned once unsealed, for health or hygiene reasons; goods that deteriorate or expire rapidly; goods that, after delivery, are inseparably mixed with other items; services fully performed with your prior express consent after you were informed you would lose the right; and digital content supplied not on a tangible medium, where performance began with your prior express consent and your acknowledgement that you thereby lose the right.

No exchanges. Within withdrawal you cannot exchange a Product for another one. If you want a different Product, withdraw from the Contract and place a new Order.

These rights belong to Consumers and Consumer-Entrepreneurs. A Customer who is not a Consumer is not entitled to withdraw.

11. Model withdrawal form

To: Bargen Invest, Henryka Barona 18/17, 82-300 Elbląg, Poland, contact@leonarto.studio
I/We hereby give notice that I/We withdraw from my/our contract of sale of the following goods:
Ordered on: ……………… Received on: ………………
Name of consumer(s): ………………
Address of consumer(s): ………………
Signature (only if this form is sent on paper): ………………
Date: ………………

Using this form is optional. A plain statement with the same information has the same effect.

12. Conformity and complaints

Legal guarantee of conformity. We are liable to a Consumer and Consumer-Entrepreneur for any lack of conformity of the Product with the Contract. Under Directive (EU) 2019/771 and its Polish implementation, that liability lasts for at least two years from delivery, and for the period set by law it is our burden, not yours, to prove whether the lack of conformity existed at the time of delivery. Goods must, in particular, match their description, be fit for the purposes we were told about, and have the qualities a consumer may reasonably expect.

Remedies. If a Product does not conform with the Contract, you may first ask us to repair it or replace it. If we refuse, fail or are unable to do so within a reasonable time and without significant inconvenience, or if the repair or replacement has not brought the Product into conformity, you may ask for a price reduction or withdraw from the Contract. If the lack of conformity is serious, you may go straight to a price reduction or withdrawal. All of this is at no cost to you: we bear the cost of collection, transport, labour and materials, and you may make the Product available to us for repair or replacement.

How to complain. Send a complaint by email to contact@leonarto.studio or in writing to the Seller's address. Include your name, the Order number or other details identifying the purchase, a description of the Product and of the defect, and what you are asking for. We reply within 14 days of receiving the complaint, by email or in writing.

What is not a defect. Normal variation between items produced to order is not a defect, and neither is a difference in colour arising from the way a screen displays an image. Damage caused after delivery — misuse, physical damage, exposure to moisture or direct sunlight, or damage caused by the Customer's own handling, framing or mounting — is not a defect. Nothing here limits your rights where the damage resulted from our packaging, from transport or from a production fault.

Damaged, defective or missing deliveries, and returns of conforming Products, are handled under the Returns & Refunds Policy. Reporting a problem to us there does not replace or shorten the guarantee described above, and does not limit any right you have under it.

This section does not apply to Customers who are not Consumers, except where the law provides otherwise.

13. Product safety

Products we place on the EU market are subject to Regulation (EU) 2023/988 on general product safety, applicable since 13 December 2024. We act as the responsible economic operator for the products we sell.

For any product safety question, suspected risk or incident, contact us at contact@leonarto.studio with "Product safety" in the subject line. Information identifying the Product, the manufacturer and any required warnings or instructions accompanies the Product; please keep it. If a safety issue requires corrective action, we will contact you and offer an appropriate remedy.

14. Intellectual property

The Store, its design, text, photographs, graphics and logos, and the artwork images we publish, are owned by us or licensed to us. You may view and use the Store for personal, non-commercial purposes. You may not copy, reproduce, resell, redistribute, frame, mirror or systematically extract the Content, use it to train machine-learning models, or use automated tools to scrape the Store, without our prior written permission. You may use the Content only for personal purposes, including in relation to material protected by copyright and material that is not.

Where our artworks come from. Our catalogue has three sources: (a) artworks in the public domain, whose copyright has expired and whose images anyone may use; (b) our own original works; and (c) contemporary designs we use under a licence from their rights holder. For a public-domain artwork, the price you pay is for the physical poster we make for you — selecting the artwork, preparing the image for print, printing it to order and delivering it — not for the artwork itself, which remains free for everyone to view and use.

When you buy a print or other artwork from us, you acquire the physical item and the right to display it privately. You do not acquire any copyright or other intellectual property right in the artwork, and you may not reproduce, distribute, sell or commercially exploit the artwork or its image in any form.

15. Personal data and marketing

How we process personal data is described in the Privacy Policy, which forms part of these Terms.

  • GDPR. You may request access to your data, rectification, erasure, restriction of processing, portability, and you may object to processing based on legitimate interests. You may also lodge a complaint with your supervisory authority — in Poland, the President of the Personal Data Protection Office (UODO).
  • California (CCPA/CPRA). California residents may have the right to know, delete, correct and obtain a copy of their personal information, and the right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are used by the CCPA/CPRA.
  • Canada (PIPEDA and provincial law). We handle personal data in accordance with PIPEDA and applicable provincial privacy legislation, and we provide access and correction on request.

For marketing we use opt-in only. If you are in Canada, we comply with Canada's Anti-Spam Legislation: we rely on your express consent or on an applicable existing business relationship; every commercial message identifies us and includes a working unsubscribe mechanism; contact information in the message stays valid for at least 60 days; and we act on opt-out requests within 10 business days.

16. Liability, indemnity and force majeure

We do not warrant that the Store will be uninterrupted, timely or error-free, or free of harmful components. Access may be suspended for maintenance or for reasons beyond our control. Content in the Store is published for general information; where it contains an error, section 5 applies.

To the extent permitted by law, we are not liable for indirect or consequential losses, such as loss of profit, revenue or opportunity. Where we are liable, our total liability in connection with an Order is limited to the amount you paid for the Products concerned.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; a lack of conformity of the Product with the Contract or a failure to deliver, to the extent the applicable law makes us liable; or any other liability that cannot lawfully be excluded. If you are a Consumer or Consumer-Entrepreneur, nothing in these Terms restricts the rights given to you by mandatory law.

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural events, transport or customs disruption, strikes, or failure of suppliers or infrastructure.

If you breach these Terms or use the Store unlawfully, you agree to compensate us for third-party claims and reasonable costs arising from that breach. This does not apply to Consumers or Consumer-Entrepreneurs to the extent such an obligation is not permitted by the law applicable to them.

17. Complaints, ADR and disputes

Please write to contact@leonarto.studio first. We aim to reply within 24 hours on Business Days and to resolve complaints within 14 days.

European Union and EEA. You may contact the consumer dispute resolution body competent for your country — the list is published at consumer-redress.ec.europa.eu — or your national European Consumer Centre. Consumers in Poland may also turn to the municipal or district consumer ombudsman (rzecznik konsumentów), submit a request to a permanent consumer arbitration court, or apply to the provincial inspector of the Trade Inspection for out-of-court resolution. We are not obliged to participate in alternative dispute resolution, but we will consider any request in good faith. The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and can no longer be used.

United Kingdom. You may refer a dispute to a certified alternative dispute resolution provider. We will tell you whether we agree to take part.

Canada. Disputes may be brought before the courts of competent jurisdiction, and nothing in these Terms prevents you from relying on the consumer protection law of your province or territory.

United States. You may bring an individual claim in small claims court, or in a court of competent jurisdiction. Except where prohibited by law, we and you agree to resolve any other dispute by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may still seek relief in court to protect its intellectual property. You may opt out of arbitration by emailing contact@leonarto.studio with the subject "Arbitration opt-out" within 30 days of your first Order, giving your name and Order number. Arbitration is individual: neither party may bring or participate in a class, collective or representative action. If a court finds part of this paragraph unenforceable, the rest remains in effect, and where a rule of your state does not permit a term of this paragraph, your state's rule applies.

Governing law. These Terms are governed by the law of Poland. For a Consumer or Consumer-Entrepreneur this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and, for Consumers in the EU, EEA and UK, you may bring proceedings before the courts of Poland or of the country in which you live.

18. Language

These Terms are published in English. If you are a consumer in Québec, a French version is available on request at contact@leonarto.studio; where the French and English versions diverge, the interpretation most favourable to you applies. Where the law of your country requires these Terms in another official language, that version prevails.

19. Changes to these Terms

The Seller makes these Terms available on the Store's website free of charge, and provides them electronically on request.

The Seller may change these Terms for important reasons, in particular: a change in the law affecting their content; a change in the Seller's identification data; a change in the business conducted by the Seller; a change in the scope of the Service; or technical or technological changes in how the Store operates.

Changes are published on the Store's website together with the date they take effect, which is not earlier than 14 days after publication. Users are also notified by email to the address given at registration. Changes do not apply retroactively to Orders already confirmed.

20. Final provisions

If any provision of these Terms is found to be unlawful, void or unenforceable, it is severed and the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours, including to a successor of our business. These Terms, together with the policies they refer to, are the entire agreement between us on this subject and replace any earlier understanding. Section headings are for convenience only.

These Terms take effect on 29 September 2026.
